Regulatory Proposals - 2024

 

2024-K - Centralized Prescription Dispensing - This proposal would amend Section 1141 of the Board's rules relative to centralized prescription dispensing.

• 08-20-2025 - Board approved the proposal and it became Regulatory Project 2025-08

 

2024-J - Pharmacy Technician Certificate Qualifications - In response to Act 253 of the 2024 Regular Session of the Louisiana Legislature, this proposal would amend Section 905 of the Board's rules to remove the practice requirement placed upon a pharmacy technician applicant from another state.

• 11-20-2024 - Board scheduled to consider Draft #1 . 
• 11-20-2024 - Board approved the proposal and it became Regulatory Project 2025-03 . 

 

2024-I - Marijuana Pharmacy - This proposal repeals Sections 2441, 2443, 2445, 2447, 2451, 2455, and 2457 of the Board's rules in response to Act 693 of the 2024 Regular Session of the Louisiana Legislature.

• 11-20-2024 - Board scheduled to consider Draft #1 . 
• 11-20-2024 - Board approved the proposal and it became Regulatory Project 2025-02 .

 

2024-H - Emergency Drug Kit (EDK) Permit - This proposal would amend Section 1711 of the Board's rules to remove the requirement placed upon the administrator of a facility (e.g. nursing home) to sign an EDK permit application.  It also amends the requirements for making available the paper permit since the Board no longer produces hard copy paper credentials.

2024-G - Pharmacist-in-Charge (PIC) Requirements - This proposal would amend Section 1105 of the Board's rules to reduce the experience requirement for a pharmacist to qualify for the PIC privilege from two years of active pharmacy practice to one year.

• 11-20-2024 - Board scheduled to consider Draft #2 .  
• 11-20-2024 - Board approved the proposal and it became Regulatory Project 2025-01 . 

 

2024-F - Prescription Transfers - The proposal amends Sections 2523 and 2747 in regard to the transfer between pharmacies of prescription or prescription information. 

• 04-25-2024 - Committee scheduled to review and consider Draft #1 . 
• 04-25-2024 - Committee developed Draft #2, then voted to recommend to the Board their approval. 
• 05-08-2024 - Board scheduled to consider Draft #2 .
• 05-08-2024 - Board approved the proposal and it became Regulatory Project 2024-07.  

 

2024-E - Prescription Monitoring Program (PMP) Advisory Council Open Meetings via Electronic Means - The proposal adds Section 2905 in response to Act 393 from the 2023 regular session which requires the Board to promulgate rules in regard to open meetings via electronic means and ADA accommodations.

• 01-24-2024 - Committee reviewed Draft #1, then voted to recommend to the Board their approval.
• 02-21-2024 - Board scheduled to consider Draft #1 .
• 02-21-2024 - Board approved the proposal and it became Regulatory Project 2024-03.

 

2024-D - Open Meetings via Electronic Means - The proposal amends Section 105 in response to Act 393 from the 2023 regular session which requires the Board to promulgate rules in regard to open meetings via electronic means and ADA accommodations.

2024-C - Durable Medical Equipment (DME) Permit Change of Ownership - The proposal amends Section 2403 in regard to DME change of ownership procedures.

• 04-25-2024 - Committee scheduled to review and consider Draft #1 .
• 04-25-2024 - Committee approved Draft #1, then voted to recommend to the Board their approval.

• 05-08-2024 - Board approved the proposal and it became Regulatory Project 2024-06.

 

2024-B - Controlled Dangerous Substances (CDS) Licensing - The proposal amends Sections 2707 and 2711 in regard to CDS license reinstatement, facility change of ownership, change to license status, and action on licenses.

• 01-24-2024 - Committee developed Draft #2, then voted to recommend to the Board their approval.
• 02-21-2024 - Board scheduled to consider Draft #2 .
• 02-21-2024 - Board approved the proposal and it became Regulatory Project 2024-01.

 

2024-A ~ Pharmacy Technicians - The proposal amends Sections 901, 903, and 905 to provide an alternative to a board-approved nationally-accredited pharmacy technician training program.  The draft proposal provides a mechanism by which a pharmacist could provide on the job training and education to a Pharmacy Technician Candidate.
