Controlled Dangerous Substance Theft or Loss
The DEA's rules for the reporting of the theft or significant loss of any controlled substances (CS) are found in 21 CFR 1301.76(b) .
When a DEA registrant experiences any theft or significant loss of any CS, the registrant must fulfill certain requirements:
- The registrant must submit an initial notification of the theft or loss to DEA and the Board within one business day of the discovery of the theft or significant loss.
- The registrant must conduct a complete CS inventory.
- If a loss is confirmed, the registrant must complete a DEA Form 106 and submit that report to DEA and the Board. If it is determined that there was no theft or loss, it is recommended that the registrant notify DEA and the Board in writing of this fact to resolve the initial report and explain why no DEA Form 106 was filed regarding the incident.
DEA requires the registrant to file a complete and accurate DEA Form 106 within 45 days after discovery of the theft or significant loss.
