I am accepting an appointment as PIC of a pharmacy. What do I do?
The minimum requirements to serve as PIC and responsibilities of the PIC are specified in Section 1105 (in-state) and Section 2307 (non-resident). You are encouraged to thoroughly review this information.
To accept an appointment as the Pharmacist-in-Charge (PIC) of a pharmacy permit requires the pharmacist to first obtain a PIC privilege. The PIC privilege is obtained by completing the Affidavit of Acknowledgment and Acceptance of Responsibility by Pharmacist-in-Charge. This affidavit is available to pharmacists when logged into their online services account by selecting Apply for a New Credential. Once issued, it is valid as long as the underlying pharmacist license is valid unless restricted by the Board; the PIC privilege requires no renewal.
Pharmacies are required to take a complete CDS inventory upon arrival of a new PIC (LAC 46:LIII.2733.C.1). https://www.doa.la.gov/media/cbkbh4zj/46v53.pdf
Serving as the pharmacist-in-charge (PIC) of a pharmacy is a privilege that comes with responsibility (LAC 46:LIII.1105). The PIC is ultimately responsible for complete supervision and management of the pharmacy, as well as the pharmacy’s compliance with all federal and state pharmacy laws and regulations pertaining to the practice of pharmacy.
The PIC is required to be present and practicing at the pharmacy for which they are the PIC no less than 20 hours per week, unless the pharmacy is open fewer hours. In that instance, the PIC shall be present and practicing at least 50 percent of the normal business hours.
The PIC is responsible for the maintenance of pharmacy records, the implementation of recall procedures, and the implementation of policies and procedures for the pharmacy.
In the event the pharmacy has a change in the designated PIC:
- The departing PIC shall give written notice to the Board and the owner of the phamacy permit of his intent to relinquish the PIC appointment no less than 10 days prior to the anticipated date of departure.
- The permit holder shall designate a new PIC no later than 10 days after the departure of the previous PIC
- The incoming PIC shall give written notice to the Board of his acceptance of the PIC appointment no later than 30 days after the depature of the previous PIC.
The Board has established an electronic method for submitting Change of PIC Notices. The permit holder, departing PIC, and incoming PIC should each access the Notice of PIC Change module within their individual online services accounts to report PIC changes.
